Hi-Tydz Foam Parties — Service Terms & Conditions

SERVICE TERMS & CONDITIONS
Effective Date: October 11, 2026

These Service Terms & Conditions apply to foam parties, snow parties, and related services provided by Hi-Tydz Foam Parties (“Hi-Tydz”).

By booking our services, the customer (“Client”) agrees to these terms and any additional written terms provided for the specific event.

1. Booking Confirmation
A booking is confirmed only after Hi-Tydz has accepted the reservation and received the required deposit or payment.
The Client is responsible for providing accurate contact information, event information, event location, and other information necessary for Hi-Tydz to provide the service.

2. Client Responsibilities
The Client agrees to:
Provide accurate event information.
Provide safe access to the event area.
Provide adequate adult supervision of participating children.
Follow all Hi-Tydz safety instructions.
Keep children and guests away from equipment unless instructed otherwise.
Inform Hi-Tydz of known hazards at the event location.
Ensure the event area is reasonably suitable for the selected service.
For standard foam parties, the Client must provide access to a working water source and electrical outlet within approximately 50 feet of the equipment unless alternative arrangements have been made with Hi-Tydz.

3. Water and Electrical Requirements
The Client is responsible for ensuring that the required water and electrical access is available unless Hi-Tydz has agreed to provide an alternative service.
Generator rental and water transportation may be available for an additional fee.
If required utilities are unavailable at the event and no alternative arrangements were made in advance, Hi-Tydz may be unable to provide the service.

4. Equipment
All Hi-Tydz equipment remains the property of Hi-Tydz unless otherwise stated.
Clients and guests may not move, alter, disconnect, tamper with, or operate Hi-Tydz equipment without permission.
The Client may be responsible for damage caused by intentional misuse, unauthorized operation, or failure to follow safety instructions.

5. Foam Events
Foam is intended for outdoor recreational use in the designated event area.
The Client agrees to follow all instructions regarding the placement and use of foam equipment.
Foam should not be intentionally directed into swimming pools or other bodies of water.
Guests entering a pool after participating in a foam event should rinse off first.

6. Snow Events
Snow events may be affected by weather, temperature, wind, precipitation, venue conditions, and other environmental factors.
Artificial snow is intended for the designated event area.
The Client agrees to follow Hi-Tydz instructions regarding equipment placement and guest safety.

7. Safety
Hi-Tydz reserves the right to pause, modify, or stop an event if conditions become unsafe.
This may include, but is not limited to:
Lightning or severe weather
Unsafe electrical conditions
Unsafe water conditions
Equipment malfunction
Unsafe behavior
Property hazards
Lack of required adult supervision
Any other condition that Hi-Tydz reasonably determines presents a safety concern
Hi-Tydz's decision to stop or modify an event for safety reasons will be made in good faith.

8. Adult Supervision
Parents, guardians, event hosts, and other responsible adults remain responsible for supervising children and guests during the event.
Hi-Tydz employees or event staff are not a substitute for parental or guardian supervision.

9. Pets
Pets may participate in designated pet-friendly events when specifically approved by Hi-Tydz.
Pet owners remain responsible for supervising their pets and for any injury, damage, or property loss caused by their pets.

10. Property Damage
The Client is responsible for notifying Hi-Tydz of known underground utilities, irrigation systems, fragile landscaping, or other hazards that could be affected by equipment placement.
Hi-Tydz will make reasonable efforts to protect the event property but cannot guarantee that lawns, landscaping, surfaces, or other property will remain completely unaffected by water, foam, snow, foot traffic, equipment, or weather.

11. Clean-Up
Hi-Tydz will perform reasonable cleanup associated with its equipment and materials.
The Client remains responsible for excessive trash, personal belongings, decorations, food, beverages, or other materials not supplied by Hi-Tydz.

12. Event Area
The Client is responsible for ensuring that the event area is reasonably accessible and suitable for the equipment.
Hi-Tydz may decline to place equipment in an area that presents a safety risk or could reasonably result in equipment or property damage.

13. Additional Charges
Additional charges may apply for:
Generator rental
Water transportation
Travel outside the standard service area
Additional event time
Additional equipment
Special setup requirements
Excessive cleanup
Equipment damage resulting from misuse or negligence
Any applicable charges will be communicated to the Client when reasonably possible.

14. Assumption of Risk and Liability Waiver
Participation in foam and snow activities involves inherent risks, including but not limited to slips, trips, falls, collisions, wet surfaces, cold or heat exposure, and other risks associated with active outdoor recreation.
Participation is voluntary.
The Client acknowledges that a separate Event Liability Waiver and Assumption of Risk agreement may be required before participation.
15. Changes to Event Details
Changes to the event date, location, package, guest count, or services must be approved by Hi-Tydz.
Changes may affect pricing and availability.
16. Entire Agreement
The booking confirmation, these Service Terms & Conditions, any applicable cancellation/weather policy, liability waiver, and other written agreements provided for the event may collectively constitute the agreement between Hi-Tydz and the Client.
17. Governing Law
These terms shall be governed by applicable laws of the State of South Carolina, without regard to conflict-of-law principles.
